Merry Christmas and happy holidays to you!

Typically the holiday season is a slower time of year in the real estate industry for most people.  Fortunately, many people have been taking my advice and jumping on some year end deals.  We've had a bunch of closings in the last 30 days and I want to say thanks to all of our customers for believing in us and giving us your business.

Our office will be closed for a few days between Christmas and New Years while we take some much needed time off to enjoy the holidays with our families.  I will still be available via cell phone and email if you need me though.

Everybody wants their bailout, but nobody wants to be accountable for the money

All these bailouts are going pretty much like I expected.  Wall Street and the banks get all their money but then when pressed to show they are opening up credit markets and helping consumers, mum is the word.  The banks don't want to disclose that.  Here is a pretty interesting CNN article regarding Where's the Bank Bailout Money?  Also an editorial in the Orlando Sentinel on this same subject.

The consumers on Main Street already know that the whole "trickle down" theory didn't work. President Bush, along with Senator McCain, and President-Elect Obama apparently do agree with it because they signed / voted for the original $700 billion dollar bailout bill.  Rumors of big executive bonuses, lavish corporate outings, and big bank acquisitions and mergers are floating around all through the news.  Thank you so much to Washington politicians for making Wall Street millionaires even richer at the expense of everyone else.

How about forcing these banks to disclose in detail everything about this bailout money within the next 15 days or else all the money will be immediately due and payable back to the US Treasury and given to local community banks, credit unions, and the Small Business Administration to loan out to the people.  To heck with the big mega banks.  May their stockings be filled with coal on Christmas.

State of Florida cracking down on unlicensed real estate activity

I have said it before and I will say it again.  If you are an investor working short sales, doing property management, or taking options on property in order to shop it around, be very very careful.  You probably need a real estate license regardless of what your attorney or investor mentor guru is telling you.

The State of Florida is watching you.  The real estate and mortgage industry is all under a huge microscope right now and they are catching people and making their lives miserable.

The Florida Department of Business & Professional Regulation chief Charles Drago just wrote in a letter to the editor re-emphasizing this today.  Orlando Sentinel commentary regarding unlicensed activity.  People are getting busted left and right. 

I hate to sound like I am scaring people, but this is serious business.  Unlicensed activity is a 3rd degree FELONY in Florida which could even lead to jail time.  Please be careful and think twice before you get too "creative" in your deals.  You might need a real estate license to do what you are doing. Begging for forgiveness may not work with the DBPR.

Foreclosures and rental properties - fraud at its finest

When working in the foreclosure arena, it is just a matter of time before you run into someone who is de-frauding or scamming someone else.  I've seen my share of scammers over the last few years.  Yesterday I got to finish cleaning up what I consider a fraud deal.

This particular deal was part of the infamous Florida condo market.  Back the week before Thanksgiving, I got to go door-knocking on a property that had just been foreclosed by the lender.  The tenant that answered the door was completely shocked to see me at her door.  Her landlord was a doctor and she had trouble believing that his condo could have been foreclosed on, but I showed her the documentation to convince her.

This tenant had moved into the condo unit back during July and the landlord was more than happy to take her first & last month's rent + security deposit.  Even though he had already been served a foreclosure notice for this unit back in March.  He obviously didn't care.  Unfortunately since the tenant didn't think to check the public records for a Lis Pendens (notice of default), the tenant was unaware that her new residence was already in foreclosure.  Note to all prospective renters, check the public records for a foreclosure notice before you give your new landlord one dime of your money.

So when I knocked on her door to tell her she needed to immediately start packing to move out, she was kind of blown away.  She asked me how she could get her last month's rent and deposit back, and all I could tell her was to call her lovely ex-landlord who basically stole her money and ripped her off.

The story does have a happy ending though.  The lender (now owner) did pay her $1500 to move out peacefully, and she did leave the condo nice and clean.

Of course the rest of the story is that this lovely doctor turned wannabe investor turned foreclosure con artist has 8 other units in this same complex that are all getting foreclosed and probably 8 other tenants that he scammed out of deposits and rent money.

I hope Santa Claus leaves him a whole truckload of coal on his front doorstep.  My next question is, does anybody want to buy a foreclosure condo near Universal Studios Orlando for super cheap???

HUD Secretary admits dismal failure in helping homeowners

This story is enough to get anyone fired up.  It comes a day after President Elect Obama chose his new HUD Secretary. Congress and the federal government spend days debating and spending billions of dollars at the drop of a hat, but when it comes to performance they are a complete embarrassment.  Their own mamas would be ashamed of them.

The big real estate bill that they passed back in July that killed down payment assistance programs, created a $7500 tax credit that you have to pay back, and was supposed to help out 400,000+ homeowners in foreclosure has only had 312 people actually qualify for aid.  That is right only 312

Congress throws around $700 billion to Wall Street bankers without batting an eye, yet when it comes to Main Street they only help 312 people.  What a farce?  How much are we paying these knuckle-heads to do basically nothing productive???

Obama makes his pick for new HUD Secretary

President Elect Obama has chosen his new HUD Secretary - Shaun Donovan.  Just like the current HUD Secretary, this guy appears to have plenty of experience in the government public housing sector but little if any experience in business, real estate, or mortgages.

    

Mr. Donovan is currently the commissioner of the New York City Department of Housing Preservation and Development.  It is a true shame that bureaucrats keep getting appointed to this post instead of people with real life experience in the real estate industry.  But I guess this is just typical Washington politics as usual.  So much for "change."  It just seems like more of the same.

Don't get me wrong. I wish Mr. Donovan well.  I hope he helps get the housing sector back on track.  That's one of my Christmas wishes anyway.    :-)

Central Florida commuter rail - traffic solution or giant boondoggle?

Commuter rail has been big talk around Orlando and Central Florida for several years.  Last year the Florida legislature came so close to approving the rail-line, but things broke down because the attorneys wouldn't tolerate giving CSX Transportation limited liability.  That's actually pretty bizarre considering the Tri-Rail in South Florida and most other similar projects around the country have this limited liability language as standard boiler plate contract language.  After all why would CSX be motivated to sell and leaseback their own rail-line if they didn't have this language built into the lease???  

   

Regardless, this is my big question "Is commuter rail really all it is cracked up to be?"  I certainly realize that in big cities like New York and Washington as well as many other countries that traveling by train is very commonplace.  The big difference between those places and Orlando is that here you can't put the trains underground because of the high water table.  So you end up with a main train line on existing train tracks above ground.  Tracks that have been in place since the day of the Florida cowboy (late 1800's) and don't necessarily represent existing traffic patterns that well.  Granted that much of the train tracks do partially mirror the Interstate-4 corridor, but that is about all.

In places like Deland, Sanford, Lake Mary, Altamonte Springs, and Orlando south of downtown the tracks get pretty far off of the main traffic corridor and do not pass through the main business or population areas of those cities.  Another big question is, "How do the people get from their homes to the train tracks?"  I've heard things like build big parking garages around the tracks - which still puts tons of cars of the road and costs additional hundreds of millions of dollars and thus may never get built.  I've also heard of building spur tracks which also costs additional hundreds of million of dollars and will cause existing businesses to get bulldozed to make way for new tracks.  The third is increasing bus lines to the tracks, but bus service has always been extremely unpopular in the Orlando area and I don't see that changing anytime soon.

So what is the answer to that question of how to get people to the actual rail stations?  I don't know.

The other $64 question is "Will it really reduce traffic and save infrastructure costs?"  The Tri-Rail line located on the CSX tracks in South Florida runs through Palm Beach, Broward, and Miami-Dade County and has been in existence since the 1980's.  It has been a huge money pit for the South Florida area for 20+ years now.  South Florida has 2 major limited access highways that run north to south through it, Interstate-95 and the Florida Turnpike and both of those roads are still jammed with cars every day.  So the Tri Rail only has had limited impact on traffic even though I am sure there are plenty of riders now-a-days with the way the economy has gotten. Some people even called the Tri-Rail expansion a big boondoggle.

I know that commuter rail is definitely a wiser idea than putting more cars of the road, but I don't know if it is truly the answer to the traffic problems of Central Florida.  It will probably never make a profit in my lifetime, but maybe it isn't supposed to.  The money to buy the tracks supposedly has all been set aside by the State of Florida and federal government.  I think it is only a matter of "when" and not "if" commuter rail will come to Central Florida.  Hopefully something good will come of it, and it won't be another giant money boondoggle for the metro Orlando area.
