Big Florida REO auction of foreclosed properties coming up next weekend

Next weekend is the start of a very large REO auction in Florida.  Next Sunday, April 6, 2008, is the auction for metro Orlando.  Although our firm does not have any of our REO foreclosure listings in the auction, I do see a few old expired short sale listings that we once had that are part of the inventory.

Another MLS Expansion into Southwest Florida - flat fee listing service expands

County and city leaders abusing Florida's retirement program

Has anybody been following this ongoing story? Many Florida city and county employees are getting paid their regular salary in addition to an early retirement check.  Where else could something like this exist but in the realms of the government???

     The local governments continue to complain at even one penny of a tax cut yet they can pay thousands of dollars to employees and elected officials in giant paychecks and retirement checks.  Workers in the private sector could only dream of such compensation.  The government wants the public to continue to believe the urban legend of how underpaid their employees are.  What a bunch of baloney?

A few weeks ago, I blogged in detail about the true compensation these employees really receive.  That analysis is not just my opinion, but salary and employment data directly from the U.S. Department of Labor and research of the Orlando Sentinel and other newspapers around the state.

If you haven't read the stories, you really should.  Please do not buy into the lies of the local governments, city halls, government run utilities, police, fire, schools, etc. that they are short of funds.  They are lying through their teeth and spending money like drunken sailors.  While the entire State of Florida is in a recession these guys are taking double and even triple paychecks through the DROP retirement program.  I can't speak for everyone, but I know of very few people in the private sector that are getting pay raises and excessive benefit packages every single year during this recession.  If anything, all I see are cut backs and layoffs.  The local government needs to do the same.  What's good for the goose is good for the gander.

There is really no excuse for this.  In fact elected officials like Earl K. Wood, Orange County Tax Collector and Orange/Osceola State Attorney Lawson Lamar (both career politicians for 30+ years) should be held accountable for this garbage.  I only wish I could vote in Orange County.  Voters need to throw these bums out of office in November, and the Florida legislature needs to immediately terminate their retirement benefits until they actually retire (which they desperately need to do).  We need some new blood in the political ranks instead of these same stale names that continue to get re-elected over and over and over again.

The Good Side of the Short Sale Business

In spite of some of the previous articles I have written on this subject, there is a definite positive side to the short sale business. When a homeowner is "upside down" on their property for whatever reason, something must be done to solve their problem.  Believe me that with the way the market is right now, lenders do not want foreclose on another property.  Lenders are already up to their eyeballs in foreclosures, short sales, and REOs.  If they can resolve another bad loan, that is a good thing for all parties involved.

If the homeowner does not want to move out and can still afford the payments, they can try and re-structure their loan with the lender via a mortgage modification agreement where the loan terms and interest rate are re-negotiated.  Or they can possibly do a forbearance agreement where the delinquent payments are added on to the back end of the loan for the homeowner to pay later. Or they can try and refinance their loan with another lender like with the new FHA Secure program.

If the homeowner simply cannot get back on track and needs to sell (or dump) their property, a short sale is a good possible alternative.  In order for a short sale to work, (1) there needs to be a legitimate hardship on the part of the homeowner (i.e. illness, death, job loss, divorce, etc.), (2) the homeowner cannot have a bunch of other assets (i.e. cash in the bank, big 401K accounts, other properties, etc.) or a big income, and (3) the net proceeds from selling the property and paying off any liens need to be greater than the total amount owed.  If all 3 of these criteria are met, then a short sale is at least a possibility. 

A short sale can be good for a homeowner in many ways.  First of all, a short sale reflects much more positively on your credit than a foreclosure.  A short sale shows up as a partial payoff, whereas a foreclosure is what it is - a repossession of a house.  A few years after the short sale, the borrower might have a great credit score again.  On the other hand a foreclosure will show bad on your credit for 7 years or more and will have to be disclosed on future credit applications.

Secondly, a short sale can often be negotiated where the personal liability of the borrower is waived and therefore no deficiency judgment can be obtained for the shorted amount. 

Thirdly, both the homeowner and the lender(s) are rid of a non-producing, unwanted asset.  An asset which is really a big alligator-sized liability in disguise.  This is often a huge relief to the homeowner who may be under incredible stress because of the imminent foreclosure situation. If the lender had to reposess this house, it may be another year before the foreclosure finalizes and the house is re-sold to a new buyer.  A short sale shortens this whole process drastically and hopefully saves the lender tens of thousands in fees and losses.

Fourthly, Congress passed a law back in December which allows this debt relief to be a non-taxable event.  So in most instances, there are no negative income tax consequences for the borrower in doing a short sale.

Fifthly, short sales keep the economy moving.  Another sale means that lenders get some of their money back to lend out again (hopefully smarter than the previous time); title companies, mortgage brokers, Realtors, surveyors, taxing authorities, etc. all get paid; a neighborhood eyesore gets cleaned up; and a new buyer gets a good deal. 

Somebody has to work through all these distressed property situations.  Either it is going to be in the pre-foreclosure stage via short sales and mortgage workout arrangements, or in the post-foreclosure REO or auction arena.  The sooner it all works through the process the better for all of us in the real estate industry.

Court gives a victory for rental property owners

Property owners received a major victory yesterday when a Florida circuit court ruled against the City of Venice (in southwest Florida).  The city was trying to place a ban on short-term rentals in the city limits.  The courts ruled that this was a taking under the 5th amendment to the U.S. Constitution and the property owner must be compensated.  Ouch!  Do you know how many property owners the city would have to pay??? I bet they don't either.

The court case has the potential to bite other local cities like Belle Isle, Mount Dora, Deltona, and Cocoa who have all placed some regulation recently on rental properties.  Many of these cities want to bite off the person's hand that feeds them (or in their case the person's hand who pays much of their taxes and fees).  If the cities are forced to make restitution for an unlawful taking of property, that may change their tune. One can only hope.

Fed cuts rate by 3/4 of a point

Yesterday the Fed cut the Federal funds rate by 3/4 of a point.  The Dow Jones proceeded to shoot up some 400 points.  Today it dropped nearly 300 points.  Another Wall Street rollercoaster ride.  I hope that one of these days it settles down.

At least with these interest rate cuts, it encourages foreigners to invest in United States assets.  We have so many British and Brazilians buying in Central Florida over the last few years it gets kind of ridiculous.  Hopefully that will help our real estate market a little bit.  At least my credit line interest rates have dropped considerably over the last few months.  It is a good time to re-evaluate your debt and refinance.  Rates are rock bottom low right now.  Hopefully some good will come of all this.

“We Buy Houses Cash” - Orlando and Central Florida - the Positives about Real Estate Investors

We have all seen the ugly little roadside signs, big billboards, or classified ads in the newspapers that say We Buy Houses Cash or Stop Foreclosure Now.  The media has often given these guys a bad rap, saying they are vultures or scammers.  While that may be true of a few bad apples, it certainly is not a true statement for most of the real estate investor industry.  In fact most of the investors that I know are just average Joe's and Jane's trying to make a few extra bucks buying, fixing, and selling properties.  (Just like you see on all those cable television shows.) Many investors are also Realtors.

   I have been known on occasion to be one of those investors myself.  During the peak years of the sizzling hot market I was buying and selling 20 to 30 properties for myself every year for several years in a row.  I have slowed down significantly in the last couple of years just because retail properties have gotten hard to sell in Central Florida.

To those who do not realize it, the We Buy Houses real estate investors actually serve a very important purpose in the overall marketplace right now.  If it were not for these people still buying properties, the amount of sales in many metropolitan areas would be down 10% or more from what they already are.

Somebody has to buy up all these short sales, foreclosures, and bank owned REO's.  The houses that are in good condition will hopefully end up selling to an owner occupant, but the houses that are in marginal condition or that cannot pass a standard 4-point inspection will most likely need to be bought and rehabbed by an investor.  Most owner occupants do not have the resources or the vision to fix up a handyman special especially in a down market.  The person that ends up buying these is the real estate investor.

The real estate investor also is pumping money through the economy and keeping people employed including title companies, mortgage brokers, lenders, Realtors®, government clerks at the courthouse, surveyors, home inspectors, Home Depot and Lowe's workers, contractors, plumbers, roofers, painters, etc.  They pay lots of money in doc stamp taxes, intangible taxes, tangible property taxes, sales taxes on materials, and real property taxes.  They clean up an eyesore in the neighborhood.  And lastly, they end up giving a new owner occupant or a tenant a nice fixed up home. 

So to all the critics out there, the investor does serve a positive purpose in the real estate market -- especially right now. I don't know about you, but I am happy just to see an offer on my listings.

More Federal aid to the rescue on Wall Street - now is the time to buy

The Federal Government in conjunction with JP Morgan Chase performed another rescue mission this weekend.  The big Wall Street investment bank, Bear Stearns Company, was bought out in a bargain basement deal by JP Morgan Chase in order to keep the bank from possibly failing.  The value of Bear Stearns dropped by nearly $5.7 billion in just a matter of minutes. Many of its investments are held by mortgage backed securities.  Some are calling this a "depression era" procedure especially since Bear Stearns has been around since before the Great Depression of the 1930's.  It is quite scary to see all this happen in the marketplace.  There are probably some big fallouts still to come because of the credit crunch and the downturn in the real estate industry.  You can read the full story in USA Today . At the same time the Fed made a rare Sunday afternoon cut to interest rates by another 1/4 point.  It looks like another wild week on Wall Street is upon us. I hope this move by the Fed keeps the stock market from crashing at the opening bell. I guess we will see shortly.  

                    

As I blogged about nearly 6 months ago, when times are bad that is the time to buy.  The big mistake people make is buying when everyone else is buying and selling when everyone else is selling.  You want to do the opposite.  Otherwise you end up buying at the top of the market and selling at the bottom of the market.  Nobody can perfectly predict the top or bottom of any market. (Heck they can barely predict tomorrow's weather, and don't even get me started on "global warming.")  But you can determine by using numbers and formulas as to whether an investment is a good deal or not.  "Blood is in the streets" so don't sit back and wait, buy now.

I have put my money where my mouth is.  Since that article I wrote back in September 2007, I have purchased 4 investment properties in Central Florida / metro Orlando and plan on conservatively buying more.  The deals are everywhere and interest rates are dirt cheap. Don't miss out on this opportunity of a lifetime.
