Another tax proposal on the Florida ballot for November

On the same day that the Florida House passed a tax cut bill that looks to go nowhere, the Taxation and Budget Reform Committee has agreed to put on the November ballot a different tax proposal measure. 

The proposed constitutional amendment would make some radical changes to property tax bills.  The amendment calls for an elimination of the portion of the property taxes that pays for schools and in turn increases the sales tax.  For Realtors and real estate investors this is probably a great thing since it will most likely reduce the taxes paid via our industry. The sales tax will put a larger burden on retailers and tourists.  Of course if this leads to a sales tax on services that throws another big burden on top of Realtors and other service providers.

One definite good thing in this amendment is that it puts a 5% annual cap on value increases for non-homestead properties.

There are a lot of big questions about this amendment.  As it gets closer to November if this amendment for sure ends up on the ballot, I will analyze it in detail as I did Amendment 1.  Here is an Orlando Sentinel article on the subject for your reading.

Are these short sale lenders just plain crazy???

What the heck is the problem with these short sale lenders???  I certainly can understand why they don't make a snap decision to approve these short sales.  Reducing the payoff of a $200,000 loan down to $150,000 is certainly not a decision to take lightly.  But on the same note, taking 4 months to make a counter-offer is absolutely ridiculous.

    I realize that a lender needs to verify that no sort of fraud was involved in both the original mortgage transaction and in the request for the short sale.  I also realize that a lender wants to make sure the property has been properly marketed and that the purchase price is a legitimate number. 

Short sales have been around for decades (if not centuries), and this giant tidal wave of short sales has been happening for going on 2 years now.  Why doesn't every lender have a straightforward policy on how they handle short sales?  Why can't most of them get a short sale fully approved in 60 days or less?

I have never heard a good answer to those questions.  In fact it seems more like the lenders are simply stonewalling everybody - seller, Realtor, title company, attorney, buyer, etc.  What is even worse? It is not uncommon for a lender to let the property go all the way through a foreclosure auction and then list the property as a bank owned REO for $30,000 less than what they could have sold it for 6 months earlier as a short sale.  I don't get it. That just seems plain stupid to me.

Granted there are some lenders that have the short sale thing down pat.  They can get them approved in less than 60 days.  I was able one time to get a lender to approve a short sale in 10 days.  But those are the exception rather than the norm that is for sure. 

I have seen many deals fall apart because the buyer gave up after 4 months of waiting.  I have seen lenders come back in November and say "We approve" for a short sale that was first implemented in June. Unfortunately the buyer was long gone.

Many buyers and Realtors have gotten wise.  When they see the words "short sale" or "pre foreclosure" in the MLS, they simply steer clear.  They won't even look at those listings unless the lender has already fully approved the price.

You would think the lending industry would try and streamline the short sale process in order to not prolong the agony.  But I guess with short sales, common sense on the part of lenders has been thrown out the window.

Florida House passes fantastic property tax reform, but in the Senate ...

On Thursday, the Florida House passed a serious property tax cut measure with votes basically split along party lines.  The Florida Senate however is a bit more reluctant and odds are high that the bill will not pass there.

   

The House bill follows the proposal of House President Marco Rubio's Cut Property Taxes Now group of limiting property taxes to 1.35% of the taxable value as set by the county property appraiser.  This measure would be a major tax reduction for non-homestead properties including landlords, snowbirds, and businesses.  The House bill would also provide for a revenue cap on government at all levels both state and local thus putting a stop to nonsense like the Winter Springs fire assessment.  The bill would provide for an amendment that 60% of voters must decide upon this November, so whether it truly passes or not would be up to the citizens of Florida anyway.

Sources estimate that it will reduce property tax revenue by about 30%.  Considering that property tax revenues have more than doubled in the last 7 years, a 30% cut should do little damage to the government's budgets if they would just reduce there budgets back to what they had a few short years ago.

The Florida Senate does not want to act.  State and local governments are already crying over budget cuts, however as I have repeatedly pointed out in previous blogs there are literally hundreds of millions (and probably billions) of dollars being flushed down the toilet on a regular basis by our state and local governments and school boards.

Amendment 1 gave tax relief to homesteaders. We need real tax relief immediately for non-homestead properties.  The Florida Senate is arrogantly thumbing their noses at its citizens.

If the Senate refuses to provide more relief to citizens (or at least give us the chance to vote on the issue), we need to thumb our noses back at them this November and fire many of its members.  Please put some pressure on your state Senators and help motivate them to vote yes on this bill.

Experiences with "Haunted Houses"

I figure many Realtors, investors, and others in the industry who have been in business for a bunch of years have come across a property that someone claimed was "haunted" or "possessed."  I have actually come across several of these myself over the last 15 years or so.  So I thought I would share a little bit from my experiences.  In Florida, we have a specific law that was put on the books about 5 years ago that relieves sellers or Realtors of any obligation to disclose if someone died or was killed in a property. The law is Florida Statute 689.25 if you want to read it.  The statute does not specifically mention haunted houses or paranormal activity, but a lot of that is associated with someone dying in a house.

    A few years ago, I sold a large executive-type home, 4000+ square feet on several acres.  The home was in a semi-rural area and a few years earlier was used as a Jewish temple.  The current owner was having major upgrades done to the house in order to prepare it for a sale.  He is a friend of mine and I was assisting him some in dealing with the contractors.  Several of the contractors swore to me that the house was haunted.  There were some saloon style doors that closed up a loft area upstairs, and they swore to me that every time they closed the doors that when they came back the next day the doors would be open.  They also claimed mysterious drafts, doors slamming by themselves, and pounding sounds in the garage.  I actually went to the house one evening when nobody was home and sort of taunted the ghosts to appear.  Kind of scary, but nothing happened.  I closed the saloon doors myself and came back 2 days later and they were still closed.  I asked the owner (who had been living there on and off for about a year) about the supposed ghosts and he said that he never saw or heard anything.

I own a rental property that has a crawlspace (the house is up on blocks).  Several years ago a tenant complained to me that they could hear an eerie knocking sound in the crawlspace at night sometimes.  The entry to the crawlspace was boarded up, so nothing could easily get in there. I poked around some with a flashlight, but did not see anything.  I asked the tenant to try and record the sound or contact me if they heard it again.  They told me about the sound 3 different times over a 1 month period.  The tenant has since moved, and I never found out what the sound was. I still own the house.  The elderly man who sold me the house had an elderly wife who used a handicap ramp to enter the house.  She died before he put the house up for sale. She may have died in there, but I don't know for sure.

About 10 years ago, I had someone call me about a house that his sister owned.  She had apparently committed suicide in the house and now the heirs were trying to sell the house.  It ended up not being a good deal, so I didn't buy it.  I distinctly remember when walking through the house that I kept getting this creepy feeling that someone was watching me.  I never saw or heard anything, but it made me feel uneasy.  Of course I have been in many houses that have just plain given me the creeps, and it didn't have anything to do with ghosts.

Right in my office building about a year and a half ago there was an incident.  In the office directly across the hall from mine, a woman employee committed suicide by putting a plastic bag over her head and suffocating.  Ewww!  The company that was in that space vacated shortly thereafter.  I don't blame them.  Many times I am working in my office all alone into the evening.  My actual room shares a common wall with the room where the suicide took place.  I haven't ever heard or seen anything out of the ordinary.  The office space has been vacant ever since that company moved out. 

With older houses and buildings, it is not uncommon for someone to pass away while in them.  It is just a sad fact of life. I would love to see or hear some sort of ghost or paranormal activity.  But I certainly wouldn't want one in a house that I live in though.  And I don't want to get attacked like in some Amityville Horror or Poltergeist movie. I try to keep an open mind, but sadly I think I will continue to be disappointed by the ghouls and goblins.

Winter Springs fire fee passes

A few days ago the City of Winter Springs FL did pass a controversial fire assessment ordinance. The ordinance was revised from the original proposal, however the average homeowner will pay an non-ad valorem assessment of approximately $115 per year in addition to their current property taxes.  This is a big sting to landlords and apartment complex owners who have to pay this fee for each unit they own.  At least the fee was reduced from the original $216 proposal.

   

Many tax payers consider this fee a slap in the face since it circumvents the spirit of the tax reform of Amendment 1 passed overwhelmingly by voters.  Other cities and counties in the area including Longwood and Orange County have looked at the example of Winter Springs and are considering a similar fee.  Luckily the City of Casselberry just recently decided against this idea at their last commission meeting.

Watch for more and more cities and counties to try and reach into your wallet as they face budget cuts because of the struggling economy.
